Terms & Conditions

Welcome to Forever on Film. By purchasing our services or engaging with us in any way, you agree to be bound by the following Terms & Conditions. Please read them carefully. If you do not agree, you should not proceed with a purchase or booking.

1. Services Provided

Forever on Film creates documentary-style life story films. Our services may include consultation, filming interviews, editing footage, and delivering a completed film in the format outlined at the time of purchase.

Each project is bespoke and tailored to the individual subject.

2. Eligibility

By purchasing our services, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are purchasing on behalf of another person, you confirm that you have authority to do so.

3. Payment Terms

  • Full payment is required upfront at the time of purchase.

  • All prices are displayed in Australian dollars and include GST unless otherwise stated.

  • Payment confirms your intent to proceed and secures your place in our production schedule.

 

4. Cancellations and Refunds

Forever on Film operates in accordance with Australian Consumer Law. Refunds are assessed based on work completed and notice provided at the time of cancellation.

  • If you cancel within 48 hours of purchase, and before any consultation or work has commenced, you may be eligible for a full refund.

  • If you cancel more than 14 days before the scheduled filming date, a partial refund may be issued, less the value of work already completed, including consultation and pre-production.

  • If you cancel within 14 days of the scheduled filming date, no refund will be issued, as production time and resources will have been reserved and cannot reasonably be reallocated.

  • Once filming has commenced or been completed, no refunds are available.

All cancellation requests must be made in writing to info@foreveronfilm.com.au.

 

5. Intellectual Property Rights

  • Ownership of the final edited film is granted to the client for personal, private use.

  • All raw footage, project files, working edits, and unused material remain the property of Forever on Film.

  • Due to the use of licensed, incidental, or background audio and visual material, Forever on Film does not grant permission for the final film to be uploaded to public video platforms such as YouTube, Vimeo, or similar services, where automated copyright enforcement may apply.

  • The client may share the film privately with family and friends and display the film in private settings.

 

6. Promotional Use

  • Unless the client opts out in writing prior to filming, Forever on Film may use short excerpts of the finished film for portfolio, website, and promotional purposes.

  • Promotional use will be handled respectfully and will never include sensitive material without consideration.

  • Clients may opt out of promotional use by notifying Forever on Film in writing before filming takes place.

7. Client Responsibilities

  • Clients must provide accurate and complete information during the booking and consultation process.

  • Clients are responsible for ensuring all participants consent to being filmed.

  • Clients must secure permission for filming in any private locations where required.

 

8. Delivery and Revisions

  • One round of minor revisions is included with each project.

  • Minor revisions are limited to small refinements such as trims, pacing adjustments, and minor audio or visual tweaks, and must not exceed two hours of total editing time.

  • Revision requests must be submitted as a single, consolidated list.

  • Requests that exceed the included scope, or involve structural changes, re-recording, or additional creative direction, may incur additional fees and will be quoted prior to further work.

Delivery timelines will be discussed during the booking process and may vary depending on project scope.

 

9. Content Standards

Forever on Film reserves the right to refuse or discontinue a project if requested content is unlawful, defamatory, or infringes on the rights of others.

 

10. Limitation of Liability

To the extent permitted by law, Forever on Film is not liable for any indirect, incidental, or consequential losses arising from the use of our services. While every reasonable effort is made to safeguard footage, we are not responsible for loss caused by events beyond our control, including equipment failure or unforeseen technical issues.

 

11. Governing Law

These Terms & Conditions are governed by the laws of Western Australia. Any disputes will be resolved in the courts of Western Australia.

 

12. Changes to Terms

Forever on Film reserves the right to update these Terms & Conditions at any time. Any changes will take effect once published on our website. Continued use of our services constitutes acceptance of the updated terms.
